These Terms of Service ("Terms") govern your access to and use of the RodeoAgent platform and services ("Service") provided by Rodeo Agent ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
RodeoAgent is a software platform that helps real estate agents create, manage, and send personalized direct-mail postcards based on property data and real estate events. The Service includes farm management, campaign generation, approval workflows, and related tools.
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must notify us immediately of any unauthorized use.
The Service is offered on a subscription basis. By subscribing, you authorize us to charge the payment method you provide for the recurring subscription fee and for any per-postcard charges you approve. Subscription fees are billed in advance. Per-postcard charges are incurred when you approve a campaign. All fees are non-refundable except as required by law or as stated in these Terms.
When you approve a campaign, you authorize us to print and mail the postcards through our fulfillment partners. You are responsible for reviewing and approving all content before it is sent. We are not responsible for delays caused by postal services or third-party printers.
You agree not to use the Service to send unlawful, deceptive, or harassing mail; to violate any applicable law (including CAN-SPAM or state privacy laws); or to infringe the rights of others. We may suspend or terminate your account for violations.
Our collection and use of personal information is described in our Privacy Policy. You are responsible for ensuring that your use of property and owner data complies with applicable law.
The Service, including its software, design, and content (excluding your own campaign content), is owned by us or our licensors. You retain ownership of the content you create or upload.
You may cancel your subscription at any time. We may suspend or terminate your access for breach of these Terms. Upon termination, your right to use the Service ends immediately.
The Service is provided "as is." We disclaim all warranties, express or implied. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits or data, arising out of your use of the Service.
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
